WILL, Senior District Judge.
An Administrative Law Judge (“AU”) awarded Dorothy Dempsey benefits under the Black Lung Benefits Reform Act, 30 U.S.C. §§ 901-945 (1976, Supp. I & Supp. II 1978). The Department of Labor Benefits Review Board (“Board”) reversed the AU’s order granting benefits and remanded the case for a determination of benefits under alternative bases of entitlement. On remand the AU found these alternative provisions unavailing, and the Board affirmed the AU’s decision and order. Mrs. Dempsey now appeals the Board’s decision to this court.
