The plaintiff in error, hereinafter referred to as the defendant, was on the 31st day of January, 1917, informed against in the district court of Greer county for the murder of John W. Stinson on the 18th day of January, 1917. Upon trial in said court the defendant was, on the 2lst day of September, 1917, convicted of manslaughter in the first degree, and his punishment fixed at imprisonment in the state penitentiary for a term of 25 years. To reverse this judgment the defendant prosecuted this appeal.
