JOHNSON, Judge.

Plaintiffs Oner MacArthur Steffey and Patricia Steffey commenced this action in Guilford County on 28 February 1992. Plaintiffs filed a complaint which alleged liability against defendant City of Burlington (City) on grounds of breach of a nondelegable duty to provide a safe workplace resulting in injuries to plaintiff husband. Summons was issued the same day, return receipt requested. On the face of the summons was entered:
