ON REHEARING.
This is a proceeding in mandamus to compel the board of county commissioners of Grand county to levy a tax for the payment of a judgment. The suit was instituted on the 21st *217day of September, 1898, and resulted in a judgment for the relator. From that judgment error was prosecuted to this court, where a reversal was adjudged. Grand County v. Savings Bank, 8 Colo. App. 43.
The specific ground on which the judgment was reversed was that there was no proof that the commissioners had refused to levy the tax. There was evidence of a meeting between Mr. Rohan, the chairman of the board,…
