Tbe plaintiff, Abell Clark, recovered a judgment in tbe circuit court of $300.00 against tbe Export Insurance Company (plaintiff in error) for damages -to bis automobile, on an insurance policy insuring it against “direct loss or damage by fire, theft and transportation to tbe body machinery and equipment.” The action was tried, upon an appeal from a justice, by the court in lieu of a jury. Tbe damage complained of resulted from tbe wrecking of tbe car by one Russell Nichols.
