In this declaratory judgment action, defendant, Bertrand T. Ungar, appeals from the trial court’s judgment finding that plaintiffs, Equitex, Inc. and Henry Fong, owe defendant no indemnification. We affirm.

In 1996, a judgment was entered against defendant in favor of Thomas W. Itin on claims under the Rights in Stolen Property statute, § 18-4-405, C.R.S.2001. The claims were based on defendant’s involvement in a 1990 stock transaction in which Fong, acting for his brother, sold Itin stock in a company called Roadmaster; the purchase price was wired to defendant’s…
