PITTMAN, Judge.

Caroline M. Siderius (“the mother”) has petitioned this court for a writ of mandamus to be issued to the Mobile Circuit Court directing that court (a) to vacate its order, entered in a divorce action brought against the mother by Kenneth V. Ford-ham (“the father”), awarding temporary custody of the parties’ two minor children to the father, and (b) to dismiss that portion of the father’s action seeking a custody determination.
