{¶ 1} In 1978, defendants-appellees Lawrence and Cynthia Raterman purchased a house at 2827 Meigs Lane in Hamilton County. Brune-Harpenau-Torbeck Builders, Inc. (“BHT”), had constructed the residence. The house was built on a hillside. Backfill was used to create a level lot and a backyard that extended as much as 29 feet beyond the subdivision’s engineering specifications. Erosion in the backyard had caused landslides to occur in 1974. The previous owners had complained to BHT. BHT had regraded the slope and leveled the backyard several times, the last time being…
