The grand jury of Jefferson County returned three indictments against appellant. Two of the indictments charged violations of Section 13-1-42, Code of Alabama 1975. This section makes it a felony to assault a law enforcement officer with a deadly instrument while such officer is engaged in the active discharge of his lawful duty or duties. The punishment prescribed for this offense is imprisonment in the penitentiary for not less than two nor more than twenty years.
