Bogdan Djoric appeals from the order of the Kenton Circuit Court denying his motion for relief pursuant to CR1 60.02. Having reviewed the record, we affirm.

Djoric, a noncitizen with legal permanent resident status, had immigrated to the United States from the former Yugoslavia in 1973. He was indicted on September 22, 2000, by a Kenton County grand jury for first-degree possession of a controlled substance, and possession of marijuana.
