OPINION

JACOBSON, Judge.

We review whether the trial court erred in concluding that James Pritchard (Pritchard) was barred from suing the State of Arizona under the claims statute, A.R.S. § 12-821.

On January 11, 1985, Pritchard was shot in the stomach by Dennis Eddy (Eddy), while Eddy was burglarizing Pritchard’s home. At that time, Eddy was in the parole custody of Arizona Department of Corrections.
