Memorandum.

The order of the Appellate Division should be modified.

The Zoning Board of Appeals of the Village of Dobbs Ferry (ZBA) appeals from an order of the Appellate Division which *968affirmed Special Term’s judgment annulling the ZBA’s decision to deny petitioner’s application for a special building permit to restore a building on his property. Petitioner owns a parcel of land located in the Village of Dobbs Ferry which has two structures located on it.
