This is a law action by Ted R. Russell against Chicago, Rock Island and Pacific Railroad Company to recover for personal injuries from a collision between an automobile owned and driven by one Petersen, in which plaintiff was a passenger, and a freight train of defendant standing on a grade crossing in Atlantic, Iowa, about 8:45 p.m., January 11, 1955. Trial resulted in jury verdict and judgment for plaintiff from which defendant has appealed.
