In an action to recover damages for conversion, etc., the defendant First Federal Savings *712and Loan Association of Rochester appeals from an order of the Supreme Court, Richmond County (Sangiorgio, J.), dated June 19, 1998, which granted the plaintiffs’ motion for summary judgment on the complaint and to dismiss its affirmative defenses and counterclaim, and denied its cross motion for summary judgment dismissing the complaint and for summary judgment on the counterclaim.

Ordered that the order is affirmed, with costs.
