FARRINGTON, District Judge.
This action was brought by A. S. Benner, as administrator, to recover from the Truckee River Gen*741eral Electric Company the sum of $30,000 damages for the death of his son, Clarence J. Benner. The deceased at the time of his death was in the employ of the Charles Butters Company, Limited, at Virginia City, Nev. Leading from the mine in which he was working to a rock-breaker several hundred feet to the east was an iron covered passageway.
