Defendant was indicted for failing to perform his duties as a road overseer in Marion Township, in McDowell County. His counsel moved to quash the bill of indictment. The Solicitor for the State admitted that Chapter 581 of the Acts of 1899, was adopted and made applicable to the township of Marion, in the county of McDowell, as is provided by section 23 of said act, and that defendant was an overseer of the'roads in Marion Township, appointed by the Justices of the Peace, under the law as amended by Chapter 501, of the Acts of 1901.
