*352STATEMENT OF THE CASE

CHRISTIE, District Judge:

The plaintiff, Donzel Lemley, sues the defendant, United States of America, for damages for personal injuries he sustained on May 20, 1966, in a fall from a scaffold at the site of the construction of the Forestry Sciences Laboratory building for the United States Department of Agriculture, at Morgan-town, West Virginia. The action is brought under the Federal Tort Claims Act, 28 U.S.C.A. § 2671, et seq., which makes the United States liable for tort claims to the same extent as a private individual under like circumstances, with certain…
