— In an action to recover damages for personal injuries, the plaintiff appeals from an order of the Supreme Court, Kings County (Vaccaro, J.), dated January 2, 1991, which denied his motion for partial summary judgment based upon a violation of Labor Law § 240 (1) against the defendant Olympia & York Battery Park Co. on the issue of liability.
Ordered that the order is reversed, on the law, with costs, and the motion for partial summary judgment on the issue of liability based upon a violation of Labor Law § 240 (1) is granted.
