—In an action to recover a down payment made pursuant to a contract for the sale of real property, the plaintiff appeals from an order of the Supreme Court, Dutchess County (Benson, J.), entered October 3, 1988, which denied its motion for summary judgment in its favor on the complaint and dismissing the counterclaim of the defendants Howard Lockwood and Bailey Manor Development Corp. The appeal brings up for review so much of an order of the same court, entered April 5, 1989, as, upon reargument, adhered to the original determination (CPLR 5517 [b]).
