In April, 1942, the Buffalo Municipal Civil Service Commission denied plaintiff, a disabled veteran, a preference in appointment to a position in the Buffalo Police Department. Another having been appointed, Manko instituted a proceeding under article 78 of the Civil Practice Act to secure his preference, oust the incumbent and compel his own appointment. The Special Term denied the application. The order was reversed and the matter remitted for proof (266 App. Div. 708).
