The defendant, Leonard Green Martin, has moved under Rule 35, Federal Rules of Criminal Procedure, 18 U.S.C.A., to correct what he alleges to be an illegal sentence.
Martin and a co-defendant were indicted on June 3, 1960, in a four-count indictment charging violations of the Internal Revenue laws relating to distilled spirits.
