CIRILLO, Judge:

This is an appeal from an Order of the Court of Common Pleas of Dauphin County, dated September 30, 1981, denying the appellant’s supplemental petition for relief pursuant to the Post Conviction Hearing Act.

On September 9, 1974, appellant Vincent Courts, after trial by jury, was convicted of murder in the first degree' 1 for the killing of Ralph Jones, and attempted murder 2 of Alan Jones arising from the same incident.
