I. INTRODUCTION

This matter comes before the court on the parties’ cross motions for summary judgment. The plaintiff is a hospital that facilitates and operates a skilled nursing facility (“SNF”). The defendant, the Secretary of the United States Department of Health and Human Services, is responsible for the administration of the Medicare program, including reimbursing SNFs for reasonable costs incurred in treating Medicare patients.…
