In an action to recover damages for personal injuries, etc., the plaintiffs appeal from an order of the Supreme Court, Kings County (Mason, J.), dated December 5, 2000, which granted the defendants’ motion for summary judgment dismissing the complaint on the ground *531that neither of the plaintiffs sustained a serious injury within the meaning of Insurance Law § 5102 (d), and denied as academic their cross motion for summary judgment on the issue of liability.

Ordered that the order is reversed, on the law, with costs, the motion is denied, the complaint is reinstated, and the matter is remitted…
