This proceeding is brought pursuant to article 78 of the Civil Practice Act to review a determination by the respondent as City Clerk of the City of Buffalo.

The respondent has determined that a certain referendum petition protesting a local law and petitioning for a referendum thereon is invalid for want of a sufficient number of valid signatures, and for this reason did not comply with applicable law. Respondent has so certified to the Common Council of the City *2of Buffalo as provided for by section 16 of the City Home Rule Law.
