The defendant was convicted of rape and he appeals. The information upon which the State went to trial was filed in the district court of Santa Fé county on April 10, 1934.' It contained two-counts, the second of which was dismissed, the State electing to go to trial on the first count, reading, except as to the italicized words in parenthesis, as follows: “That Ricardo Alarid, Jr., late of the County of Santa Fe, State of New Mexico, on the 3rd day of April, A.
