This appeal on questions of law is from an order of the Common Pleas Court of Huron County, Ohio, dismissing the action.

The petition plaintiff filed in the Common Pleas Court on November 15, 1961, alleges a cause of action for personal injuries against the defendant railroad for its alleged negligence and upon the authority of and under the provisions of the Federal Employers’ Liability Act, Title 45, Section 56, D.
