This proceeding is brought under article 79 of the Civil Practice Act, which authorizes a simplified proceeding for the determination of any matters involving or relating to express trusts which the Supreme Court has jurisdiction to decide in an action. The petitioner has applied for an intermediate judicial settlement of its accounts as trustee of an inter vivos trust, and, in connection therewith, for a construction of a paragraph of the trust agreement providing for the disposition of the principal of the trust upon the death of the life beneficiary who is now eig¿ty-two years old.
