This case came before a three judge panel of this court on December 16,1997, pursuant to an order directing the plaintiff Steven Kraftcheck (plaintiff) to appear and show cause why the issues raised in this appeal should not be summarily decided. The plaintiff appeals from a judgment of the Superior Court affirming a decision of the zoning board of review of the town of North Smith-field (board).1 The board denied his application for a variance from lot size and frontage dimension requirements finding the subject lot had merged with an adjacent lot of record.
