In a proceeding pursuant to CPLR article 78 to review a determination of the State Liquor Authority (the authority) denying petitioner’s application for a new eating place beer license, the appeal is from a judgment of the Supreme Court, Queens County, dated September 28, 1979, which granted the petition, annulled the authority’s determination, and directed the authority to issue the license to petitioner, upon the filing of the proper fee and bond.
