Jerrell, the plaintiff below, instituted an action at law against the railroad company, to recover for personal injuries sustained by him as a result of a collision between an automobile in which he was riding as a guest and a train of the defendant company at a railroad street crossing in the city of Portsmouth. At the conclusion of the testimony of the plaintiff and before any testimony had been offered for the defendant, the trial court struck out all of the plaintiff’s evidence upon the motion of the defendant, and a verdict in favor of the defendant resulted, upon which judgment was…
