The plaintiffs in error having an execu-*804tkm against one John M. Hamilton, caused it to be levied upon the three negro slaves in controversy, namely, Clara, Nice and Nelson. The defendant interposed a claim under the statute, and the trial of the right of property coming on, the plaintiffs proved that said slaves, at the time of the levy, were in the possession of Hamilton, the defendant in the execution, and had been since the year 1834, and having proved their value, rested.
