1Opinion of the CourtWhitehouse, J.
The plaintiff performed labor for S. B. Nutter, and received from him in payment a written order requesting the defendant to pay to the bearer the amount specified, and charge the same to the drawer. The plaintiff duly presented the order to the defendant for payment. The defendant inspected it, promised to pay it, and carried it away with him. He never paid the plaintiff the amount named in the order but *243retained possession of it, and produced it at the trial. It was not accepted in writing.
