Appellant Arthur Tortorello appeals from a judgment of conviction entered upon a jury verdict returned November 12, 1971 after a ten day trial before Milton Pollack, District Judge, in the Southern District of New York finding Tortorello guilty on two counts of sale of unregistered securities, in violation of Section 5 of the Securities Act of 1933, 15 U.S.C. § 77e(a) (1) and (2) (1970); on two counts of violation of the anti-fraud provisions of Section 17(a) of the Securities Act of 1933, 15 U.S.C. § 77q (a) (1970); on one count of mail fraud, in violation of 18 U.S.C.…
