The defendant, John E. Coady, brought the present action in the circuit court of Madison County seeking post-conviction relief. The defendant had previously pleaded guilty to charges of felony murder, armed robbery, and home invasion. In the post-conviction petition, the defendant requested vacatur of the armed robbery conviction, contending that it was an included offense of felony murder.
