MEMORANDUM ORDER

CLARKE, District Judge.

This matter comes before the Court on appeal from the United States Bankruptcy Court for the Eastern District of Virginia. For the reasons set forth below, the decision of the Bankruptcy Court is AFFIRMED.

I. RELEVANT FACTS AND PROCEDURAL HISTORY

On November 21, 1988 Henry Lee Foiles (“Foiles”) filed a Bill of Complaint with the Circuit Court for the City of Fredericksburg (the “Divorce Court”) seeking a divorce against Helen W.
