Respondent was incarcerated when his son was born in 2006 and until his release on parole in September 2008. While respondent was incarcerated, his son was in the care of his sister and brother-in-law because the parental rights of the child’s mother were terminated when the child was 10 weeks old. Respondent was reincarcerated in July 2009 when he violated his parole and remains incarcerated.
