This is a libel in personam to recover for loss arising from the breach of three certain contracts of affreight - ment, entered into between the libelant and the respondent, on the 24th of September, 1916, the contracts briefly being that respondent would furnish freight room and transport for the libelant 300,000 cases of refined petroleum, naphthas, and/or turpentine, from New York to certain named ports in Australia and New Zealand, at the price of $1 per case, with the right of the shipowner to call for 10 per cent, additional.
