BARNETTE, Judge.

This is a suit for recovery of $5,477, being the amount due on account of the nonpayment of a draft given in payment for a Cadillac automobile allegedly sold by plaintiff, Pontchartrain Motor Company, Inc., to defendants Ripoll Robert and Mrs. Mary C. Robert.

The draft in question was drawn on United Benefit Fire Insurance Company by its claims adjuster in settlement of a claim of its insured Ripoll Robert resulting from destruction of another Cadillac in hurricane “Betsy.” The total price of the Cadillac was $5,647. Robert gave his personal check for $170 to cover the excess…
