On March 3, 1920, appellee’s mother, Zora 'Saffell, now Zora Claxton, as his guardian, together with 'Cecil Saffell, an adult brother of appellee, executed to the Bant of Black Bock a joint and several promissory note for $1,500, due January 1, 1921, with interest at 8 per cent, per annum until paid. This $1,500' was borrowed to pay one-half the purchase price of a certain tract of land, title to which was taken in the name of Cecil Saffell and appellee, each of whom furnished an additional $750' to complete the purchase price thereof.
