MEMORANDUM OF DECISION

CLARIE, Chief Judge.

The named plaintiffs 1 have filed this § 1983 action on behalf of themselves and all others similarly situated, to enjoin the defendant, the Commissioner of the Connecticut Department of Social Services (DSS), from enforcing a DSS regulation which calls for interspousal income attributions in determining eligibility for Title XIX (Medicaid) benefits. 2 The effect of the said regulation is to allocate all but $2662 of a qualified couple’s yearly income, from whatever source, to institutional support, where one of the spouses is confined for a long term…
