This is an action of ejectment brought by the Union Pacific Bailroad Company. Judgment below was for plaintiff and defendants bring the case here on appeal.

In 1862 Congress passed an act granting to the *176Leavenworth, Pawnee & "Western Railroad Company, and its successors in title, a 400 foot right of way through the public lands from the Missouri river, where Kansas City is now located, westerly in Kansas to the 100th meridian.
