FUNDERBURK, Justice.
Will Barron, a resident of Dawson County, filed this suit in Mitchell County against O. Lambeth, alleged to 'be a resident of Mitchell County, and against Gus White and W. G. White, residents of Dawson County. Plaintiff alleged that defendants were partners and that as such they operated a cotton gin in the years 1928, 1929 and 1930 in Dawson County under the name of Lambeth & White Brothers Gin.
