Plaintiff in error, Armos Dixon, was indicted by a Grand Jury of Manatee County, Florida, for murder in the first degree for the unlawful killing of Joe Perry on the 21st day of May, 1939. On July 3, 1939, the plaintiff in error, hereinafter referred to as the defendant, was arraigned and entered a plea of not guilty. The defendant was placed on trial and convicted of the crime of murder in the second degree and was by the trial court sentenced to the State Prison at hard labor for a period of twenty years. A motion for a new trial was made and overruled, and on writ of error to said judgment…
