The appeal is from an order denying a new trial after the court affirmed an assessment for benefits against appellants, made by the common council of the city of St. Paul for the improvement which, for short, may be called the changing of the grade of University avenue and Robert street from Capitol boulevard to Central avenue. By another proceeding, and in contemplation of this improvement, the city had acquired the necessary ground for slopes and additional ground to the south of the intersection of University avenue and Robert street to make an easy curve, and a wide paved space into which…
