This suit was brought by appellee against appellant for damages on account of appellant’s failure to deliver to him, at Dora, Ala., certain baggage consisting of samples, which the appellant undertook, as a common carrier of passengers, to transport from Birmingham to Dora, as an incident of the *322transportation of plaintiff from Birmingham to Dora. The appellee was a traveling salesman, selling goods on commission; i. e., his compensation depended upon the amount of goods sold by him.
