NICHOLLS, C. J.
The defendant was indicted for murder by the grand jury, was found guilty of manslaughter on 'the 22d of October, 1902, by a jury, and sentenced to 20 years in the penitentiary. He has appealed, relying for reversal upon the refusal of his application for a new trial (filed October 29th), which was grounded on the alleged discovery of new evidence.
