Mason, J.:

On. December 11, 1911, in the district court of Cherokee county, sitting at Columbus, a number of defendants pleaded guilty to violations of. the law relating to the sale of intoxicating liquors. They have not been sentenced. Oh December 30, the attorney-general applied to this court for a writ o'f .mandamus requiring sentence to be pronounced. An answer to the application has been filed and the case is submitted upon a motion of the state for judgment upon the pleadings.
