Petitioner Qui Guan Di Zhang (“Zhang”), an alien who was not admitted to the United States and who is subject to removal by reason of his conviction of conspiracy to smuggle other aliens into the United States in violation of 8 U.S.C. § 1324(a)(1)(A)(v)(I) (Supp. II 1996), petitions under the Immigration and Nationality Act, as amended (“INA” or the “Act”), 8 U.S.C. § 1101 et seq.
