Appellant was convicted of theft of an automobile from A. DeZavala, and his punishment assessed at ten years in the penitentiary.

Many bills of exception were presented to the trial judge by appellant, and some were qualified and explained by the judge and filed by him with the clerk. After they were so filed appellant caused affidavits to be made, one by himself, one by his wife, one by his attorney, G. C. Edwards, and another by G. C. Edwards as agent for Currie McCutcheon, who was also appellant’s attorney. These affidavits were to the effect that the bills as originally…
